Free software and Open-source software

debian-private の方でフリーソフトウェアとオープンソースソフトウェアの
違いが話題になっていましたので、そこでも話にでてきていた 
Richard Stallman 氏の文章をえいやっと訳してみました。

にあります。原文は HTML(SGML?) で書かれてますが、めんどくさかったので
訳は英文併記のテキストベタ書きです。

あんまり Debian とは関係ない文書で申し訳ないんですが、
もしよかったら読んで感想なり誤訳の指摘なり出していただけると
うれしいです。なにせ後半はぼろぼろだと思うので。

Why ``Free Software'' is better than ``Open Source''
どうして「フリーソフトウェア」は「オープンソース」より好ましいのか

Some free software developers have started to use the term ``open
source software'' instead of ``free software.''  While free software
by any other name would give you the same freedom, it does make a
difference which name we use.  This article describes the two reasons
that have been offered for the change, and explains why in both
respects it is better to stick with ``free software.''

フリーなソフトウェアを開発している人々の一部が、「フリーソフトウェア」の
代わりに「オープンソースソフトウェア」ということばを使いはじめました。
たしかに、それがフリーなソフトウェアである限り、どんな名称で呼ばれようと
も皆さんに同じ自由を与えてくれるのでしょうが、本当は私たちがどの名称を使
うかで大きな違いがあるのです。この文章で私は、「オープンソース」という名
称の使用をやめるべきだとする二つの理由を述べ、またその二つの見地から「フ
リーソフトウェア」という言葉に固執することの意義を説明したいと思います。

Ambiguity
あいまいさについて

The term ``free software'' has an ambiguity problem: an unintended
meaning, ``Software you can get for zero price,'' fits the term just
as well as the intended meaning, software which gives the user certain
freedoms.  We address this problem by publishing a more precise definition of free
software, but this is only a partial solution; it cannot
completely eliminate the problem.  An unambiguously correct term would
be better. 

「フリーソフトウェア」ということばの定義はあいまいです。「ユーザにある種
の自由を与える」というのが本来の意味だったのですが、そこに当初予期してい
なかった「タダで手に入るソフトウェア」という意味が加わりました。「もっと
厳密なフリーソフトウェアの定義を！」と題する文章において私たちはこの問題
に言及しましたが、そこで述べられているのは部分的な解決策でしかありません。
問題を完全に除去するものではないのです。あいまいさのない正確なことばを使
うのに越したことはありません。

But nobody has found an unambiguously correct alternative for ``free
software'' in English.  (Some languages, such as French and Spanish,
provide obvious clear terms.)  Every proposed replacement for ``free
software'' has the same kind of semantic problem, or worse--and this
includes ``open source.''  Where ``free software'' has multiple meanings,
not just the intended one, ``open source'' has just one natural meaning,
and it is not the intended one.

しかし、英語においては、「フリーソフトウェア」ということばの、あいまいさ
がなくて間違いのない言い替えはいまだに見つかっていないのです(フランス語
やスペイン語のような他の言語には、疑問の余地の無い明快な言い替えが存在し
ています)。いままでに提案された「フリーソフトウェア」 という語の代替品は
必ず何らかの意味上の問題を抱えており、場合によっては元のことばよりもっと
ふさわしくないことさえあります。その一例が「オープンソース」ということば
です。というのも「フリーソフトウェア」という語の問題点というのは、このこ
とばは本来の意味以外にも多くの意味を持っていて誤解を招く恐れがある、  と
いうだけのことですが、「オープンソース」ということばは普通に理解する上で
はたったひとつの意味にしかとれず、そしてそれは私たちが意図するものとは違
うからなのです。

The obvious meaning for ``open source'' is ``You can get the source
code.''  This category is distinctly not the same as free software.
It includes free software, but also includes semi-free
programs such as Xv, and even proprietary programs such as Qt.

「オープンソース」ということばのすぐにわかる意味というのは、ソースが手に
入りますよ、ということです。このカテゴリに含まれるソフトウェアがフリーな
ソフトウェアであるとは断言できません。それはフリーなソフトウェアを含んで
いるでしょうが、しかし XV のような「半分フリー」のプログラムや、Qt  のよ
うな市販ソフトウェアすらも含んでしまいます。

Of course, it is possible to address this by publishing a precise
definition for the term, just as we do now for ``free software.''  The
people using ``open source'' have done so.  But this partial solution
is only partially effective no matter which term we apply it to.  For
free software, we have to teach people that we intend one meaning
rather than another which fits the words equally well.  For open
source, we would have to teach them to use a meaning which does not
really fit at all.

もちろん、「オープンソース」ということばに、いま私たちが「フリーソフトウ
ェア」ということばに対して行っているような厳密な定義を与えることは可能で
す。実際、「オープンソース」ということばを使っている人々は今までそうして
きました。しかし、どんな使用条件を設定したところで、この部分的な解決策は
部分的にしか有効ではないのです。「フリーソフトウェア」ということばについ
ては、私たちは人々に、このことばはいろいろな意味にとれるだろうが、正しい
のはこれなのだ、と教えなければならないわけですが、「オープンソース」とい
うことばについては、私たちは彼らに、実際のところことば本来の意味には全く
そぐわないことばの使い方を教えなければならないのですから。

Fear of Freedom
自由に迫る危険

The main argument for the term ``open source'' is that ``free software''
makes some people uneasy.  That's true: talking about freedom, about
ethical issues, about responsibilities as well as convenience, is
asking people to think about things they might rather ignore; this can
trigger discomfort.  It does not follow that society would be better
off if we stop talking about these things.

「オープンソース」ということばを使用することの論拠の最たるものは、「フリ
ーソフトウェア」ということばが人々を落ち着かなくさせるということです。な
るほどその通りでしょう。自由について、倫理に関する問題について、便利さと
セットの責任について語ることは、人々に、できれば知らんぷりしたいようなこ
とを考えることを要求するわけですから、これは不快感を呼び起こしかねません。
しかし、だからといって私たちがこれらについて口をつぐめば社会がいっそう安
楽になるというものでもないのです。

Years ago, free software developers noticed this discomfort reaction,
and some started exploring an approach for avoiding it.  They figured
that by keeping quiet about ethics and freedom, and talking only about
the immediate practical benefits of certain free software, they might
be able to ``sell'' the software more effectively to certain users,
especially business.  The term ``open source'' is offered as a way of
doing more of this--a way to be ``more acceptable to business.''

何年も昔、フリーなソフトウェアの開発者たちは、ある人々が「フリーソフトウ
ェア」ということばに不快感を覚えるという事実に気づき、そして一部はこれを
避ける方法を探し始めました。かれらは倫理や自由について口を閉ざし、特定の
フリーなソフトウェアの即効的で実用的な恩恵のみを強調するようになったので
す。彼らは、ソフトウェアをある種のユーザ、とくにビジネスの世界においては
より効果的に「売り込む」ことができるようになったかもしれません。「オープ
ンソース」ということばは、フリーなソフトウェアを「もっとビジネスで受け入
れられるように」する道を開いたのでした。

This approach has proved effective, in its own terms.  Today many
people are switching to free software for purely practical reasons.
That is good, as far as it goes, but that isn't all we need to do!
Attracting users to free software is not the whole job, just the first
step.

そういう目的についていえば、このやり方は効果的であることが実証されました。
今日多くの人々が、純粋に実用性の観点からフリーなソフトウェアに乗り換えつ
つあります。これはたしかに良いことです。しかしそれは私たちに必要なこと全
てではないのです！ユーザをフリーなソフトウェアに引き寄せることは仕事のす
べてではなく、第一歩に過ぎないのですから。

Sooner or later these users will be invited to switch back to
proprietary software for some practical advantage.  Countless
companies seek to offer such temptation, and why would users decline?
Only if they have learned to value the freedom in free software for
its own sake.  It is up to us to spread this idea--and in order to do
that, we have to talk about freedom.  A certain amount of the ``keep
quiet'' approach is useful for the community, but we must have plenty
of freedom talk too.

遅かれ早かれ、これらのユーザは、何か現実的な長所を示されて、市販ソフトウ
ェアに戻るよう勧められるでしょう。数え切れない程多くの企業がユーザを釣る
餌を求めて日夜努力しています。それをどうしてユーザが拒否するでしょうか？
ユーザがフリーなソフトウェアというものそれ自身のための自由の価値を理解し
ていた場合のみ、彼らは誘惑を拒むのです。この自由の思想が広まるかどうかは
私たち次第です。そしてこの思想を広めるために、私たちは自由について議論し
なければなりません。「だんまり戦術」は、ある程度はフリーなソフトウェアの
コミュニティに有益でしょう。しかしそれでも私たちは、自由について活発に話
し合わなければならないのです。

At present, we have plenty of ``keep quiet'', but not enough freedom
talk.  Most people involved with free software say little about
freedom--usually because they seek to be ``more acceptable to
business.''  Software distributors especially show this pattern.  Some
GNU/Linux operating system
distributions add proprietary packages to the basic free system, and
they invite users to consider this an advantage, rather than a step
backwards from freedom.

現在のところ、私達は多くの場合「黙って」いて、十分に自由を語ってはいませ
ん。フリーなソフトウェアに関わっている人々の多くは自由についてはあまり語
りません。というのもたいてい彼らは、フリーなソフトウェアがビジネスの世界
でもっと受け入れられるようにするにはどうしたらよいかしか考えていないから
です。ソフトウェアの配布元はとくにこの種の傾向が強いのです。GNU/Linux オ
ペレーティングシステムの配布元の一部はフリーの基本システムに市販ソフトウ
ェアを追加し、ユーザには、これら市販ソフトウェアは便利なんですから、自由
という観点からは後退でも、それには目をつぶりませんか、と誘っています。

We are failing to keep up with the influx of free software users,
failing to teach people about freedom and our community as fast as
they enter it.  This is why non-free software such as Qt, and
partially non-free operating system distributions, find such fertile
ground.  To stop using the word ``free'' now would be a mistake; we
need more, not less, talk about freedom.

私たちは急増するフリーなソフトウェアのユーザの要求に対応しきれなくなりつ
つあり、人々に自由について教えることに失敗しつつあり、そしてこの世界に参
入したての人々にすぐさま私たちのコミュニティについて教えるということもで
きなくなりつつあります。これが Qt のようなフリーではないソフトウェア、あ
るいは部分的にフリーではないオペレーティングシステムディストリビューショ
ンが圧倒的な支持を集める理由です。今「フリー」ということばの使用を止める
ことは間違いなのです。私たちはもっともっと自由ということについて議論しな
ければならないのです。

Let's hope that those using the term ``open source'' will indeed draw
more users into our community; but if they do, the rest of us will
have to work even harder to bring the issue of freedom to those users'
attention.  We have to say, ``It's free software and it gives you
freedom!''--more and louder than ever before.

「オープンソース」ということばを使う人々は、これからも私たちのコミュニテ
ィにより多くのユーザを引き寄せる力になってくれるでしょう。しかしもしそう
だとしても、残りの私たちは自由ということにユーザの関心を引くことによりい
っそう努力しなければならないでしょう。私たちは今までよりももっと声高に、
こう主張しなければなりません。「それはフリーなソフトウェアで、あなたに自
由を与えるものなのです！」

Misunderstandings(?) of ``Open Source''
「オープンソース」にまつわる誤解(？)

The Open Source Definition is clear enough, and it is quite clear that
the typical non-free program does not qualify.  So you would think
that ``Open Source company'' would mean one whose products are free
software, right?  Alas, many companies are trying to give it a
different meaning.

「オープンソース」の定義は単純明解、そしていわゆるフリーじゃないプログラ
ムにその名を名乗る資格がないことも明らかです。というわけで皆さんは「オー
プンソースカンパニー」というのは製品がフリーなソフトウェアである会社を指
すと思いますよね？悲しいかな、多くの企業はこのことばに違った意味を持たせ
ようとしているのです。

At the ``Open Source Developers Day'' meeting in August 1998, several
of the commercial developers invited said they intend to make only a
part of their work free software (or ``open source'').  The focus of
their business is on developing proprietary add-ons (software or manuals) 
to sell to the users of
this free software.  They ask us to regard this as legitimate, as part
of our community, because some of the money is donated to free
software development.

１９９８年８月に開催された「オープンソース開発者の日」の集いにおいて、招
待された企業デベロッパの内何人かは、彼らは製品のほんの一部だけをフリーな
ソフトウェア(あるいは「オープンソース」)にするつもりだと述べました。彼ら
の商売の眼目は、市販アドオンソフトウェアやマニュアルを開発してフリーなソ
フトウェアのユーザに売り付けることなのです。彼らは私たちにこれを合法とし
て、すなわちわれわれのコミュニティの一部として認めろと要求しています。い
くらか金をフリーなソフトウェアの開発に寄付するから、というのです。

In effect, these companies seek to gain the favorable cachet of ``open
source'' for their proprietary software products--even though those
are not ``open source software''--because they have some relationship
to free software or because the same company also maintains some free
software.  (One was quite explicit about trying to make that part of
their work as small as they could get away with.)

ようするにこれらの企業は、「オープンソース」の旗印を掲げることで彼らの市
販ソフトウェア製品に、たとえそれらが「オープンソースソフトウェア」でない
にしても、その企業がフリーなソフトウェアと何らかの関係があるとか、同じ企
業がいくつかのフリーなソフトウェアを保守管理しているからと言う理由で (と
はいえある企業なんか、 最低限しか仕事をしないつもりなのがみえみえですが)
好意的な印象を集めようとしているわけです。

Over the years, many companies have contributed to free software
development.  Some of these companies primarily developed non-free
software, but the two activities were separate; so we could put their
non-free products aside, work with them on free software projects, and
honestly thank them afterward for their free software contributions.

長い年月に渡り、多くの企業がフリーなソフトウェアの開発に貢献して来ました。
それらの企業のうちいくつかは元はフリーではないソフトウェアを開発していま
した。しかしその二つの活動はきちんと分けられていたのです。そこでわたした
ちはかれらのフリーではない製品のことは棚に上げておいて、彼らとフリーソフ
トウェアのプロジェクトで提携でき、そしてプロジェクト終了のあかつきには、
彼らに心からフリーなソフトウェアに対する貢献に関して感謝できたわけです。

What is different here is that these companies aim to blur the
distinction; they want us to regard their non-free software as a
contribution when in fact it is not.  They present themselves as
``open source companies'', hoping that we will get a warm fuzzy
feeling about them, and that we will be too fuzzy-minded to be
selective in how we apply it.

ここで大きな違いは、先述したような「オープンソースカンパニー」はフリーと
そうではないものの境界をぼやけさせることを目的としているということです。
彼らは事実それがそうでなくても、私達に彼らのフリーではない製品を私たちの
コミュニティに対する貢献とみなすよう要求しているのです。彼らは「オープン
ソフトウェアカンパニー」として振舞うことで、我々がなんとなく彼らに好意的
な感情を持つこと、そして私たちの考えをぐらつかせて何を選んだらよいかすら
分からなくさせることを狙っています。

This manipulative practice would be no less deceptive if they did it
using the term ``free software''.  But companies do not seem to use
the term ``free software'' that way; perhaps its association with
idealism makes it unsuitable for such misuse.  The term ``open
source'' opened the door for it.

もし彼らが「フリーソフトウェア」ということばを使うというのならば、こ
の情報操作的手法は、欺瞞以外の何物でもないのです。しかし企業は「フリーソ
フトウェア」ということばををその意味では使おうとしていないようです。多分
「フリーソフトウェア」ということばの持つ理想主義との関連性がそのような誤
用と相容れないのでしょう。「オープンソース」ということばはそういう誤用に
道を開くものです。

At a trade show in late 1998, dedicated to the operating system often
referred to as ``Linux'', the
featured speaker was an executive from a prominent software company.
He was probably invited on account of his company's decision to
``support'' that system.  Unfortunately, their form of ``support''
consists of releasing non-free software that works with the system--in
other words, using our community as a market but not contributing to
it.

Linux として知られるオペレーティングシステムを大きく取り上げた１９９８年
後期の見本市で、ある著名なソフトウェア企業の重役が特別講演者として招かれ
ていました。彼は多分彼の会社の、Linux を「サポート」するという決定のため
にそこに呼ばれていたのでしょう。不幸なことに、彼らの言うところの「サポー
ト」とはフリーではないソフトウェアを Linux  システム対応にして発表すると
いうことで、言い替えれば、私達のコミュニティを市場としてしか考えておらず、
貢献しようということではなかったのです。

He said, ``There is no way we will make our product open source, but
perhaps we will make it `internal' open source.  If we allow our
customer support staff to have access to the source code, they could
fix bugs for the customers, and we could provide a better product and
better service.''  (This is not an exact quote, as I did not write his
words down, but it gets the jist.)

彼は言いました。「我々の製品をオープンソースにするのは不可能です。しかし
多分我々は「内部的」にはオープンソースにすることができるでしょう。顧客サ
ポートのスタッフがソースコードにアクセスできるようになれば、彼らはお客様
のためにバグを修正することができ、そうすれば我々はより良い製品とより良い
サービスを提供することができるでしょう」 (これは彼の発言の正確な引用では
ありません。  わたしは彼の言葉を書き留めておかなかったので。しかし内容は
こういうことでした。)

People in the audience afterward told me, ``He just doesn't get the
point.''  But which point didn't he get?

後で聴衆は私に言いました。「彼は分かってないだけなんだよ。」しかし彼は何
をわかっていないというんでしょう？

It wasn't the point of the term ``open source''.  That term says
nothing about freedom.  It says only that allowing more people to look
at the source code and help improve it will make for faster advance of
technology.  This executive grasped that point completely; unwilling
for other reasons to carry out this approach in full, users included,
he is considering implementing it in part, within the company.

「オープンソース」ということばが分かっていないのではありません。このこと
ばは自由について何も触れていないのですから。多くの人々にソースコードを見
ることと、テクノロジのますます急速な進歩に寄与するべく改良の手助けをする
ことを許すということでしかないのです。この重役はそれをちゃんと理解してい
ます。あまり大っぴらにソースを公開するとやっかいなことになりそうなので、
彼は会社の中で部分的に実行しようと考えているのです。

The point that he missed is the point that ``open source'' was
designed not to convey: the point that users deserve
freedom.

彼が分かっていないのは、「オープンソース」は譲渡できないようデザインされ
ているということ、そしてユーザは自由を要求する権利があるということなので
す。

Spreading the idea of freedom is a big job--it needs your help.  The
GNU project will stick to the term ``free software'', and I hope that
you will too.

自由の思想を広めるのは大変な仕事です。皆さんの助けが必要です。GNU プロジ
ェクトは「フリーソフトウェア」という言葉に固執しつづけます。そして私は、
皆さんもそうしてくださることを願っています。
